Since December 2024, four separate regulatory shifts have reshaped what a UK developer must consider at acquisition stage. Land written on 2022 or 2023 assumptions can now fail planning on climate, habitat or financeability grounds.

Schedule 7A TCPA 1990 mandates minimum 10% BNG for major development. Environment Bank reference price ~£27k per off-site biodiversity unit (June 2025), with statutory uplifts of +33% or +100% for cross-boundary delivery. Typical scheme-level cost £30k–£150k, material for viability.

Paragraph 174 broadens the test to all sources of flooding — surface water, groundwater, reservoir — not just rivers and sea. "Clear" reason for refusal tightened to "strong".

Paragraphs 23, 27, 27a and 28 updated. Surface water modelling scrutiny raised. Proportionate search areas clarified. LPAs and LLFAs expected to interrogate the evidence closely.

PRA SS5/25 enters force
UK banks and insurers under formal obligation to assess physical climate risk at property level. Developer exit markets will feel the tightening within 24 months.

Gladman judgment — Sequential Test clarified
High Court ruling confirmed that a Sequential Test failure is not automatically fatal — planning balance applies. Developers with strong site-specific flood risk evidence can succeed on marginal sites; those without clear evidence lose. Raises the premium on decision-grade data at acquisition stage.
